Terms of Service

1. Acceptance of Terms

By downloading, registering for, accessing, or otherwise utilizing the Alone&Alright mobile application, you ("User") enter into a legally binding contract with Alone&Alright ("Company"), an entity headquartered and operating under the laws of the Netherlands. If you do not agree to these provisions in their entirety, you must immediately refrain from accessing or using the application.

2. Eligibility and Identity Verification

To use the application, you must:

  • Be a natural person aged 18 years or older.
  • Identify as a woman.
  • Successfully complete the platform's biometric identity verification process prior to accessing community features.

Legal Justification: The restriction to female users is legally justified under Article 4(5) and Recital 16 of EU Directive 2004/113/EC and the Dutch General Equal Treatment Act (Algemene Wet Gelijke Behandeling), which permit gender-specific service provision for the protection of physical safety.

Falsifying identity, age, or gender to gain unauthorized access constitutes a material breach of these Terms and will result in immediate, permanent account termination without eligibility for a refund.

3. Description of Services and Operational Disclaimers

Alone&Alright provides the following digital services:

  • Real-time neighbourhood safety scores and aggregated crime insights
  • A closed community platform for identity-verified women to share safety reviews and alerts
  • Offline map downloads for navigational redundancy
  • Smart trip planning with pre-vetted routes and bundled booking capabilities
  • Vetted transit and taxi recommendations

4. Payment Terms and Right of Withdrawal

Access to Alone&Alright requires a one-time lifetime payment of €7.99. No subscriptions or recurring fees will be charged.

Waiver of the 14-Day Cooling-Off Period

Under the EU Consumer Rights Directive and Article 6:230p of the Dutch Civil Code, consumers generally have a 14-day right of withdrawal. However, an exception applies for digital content not provided on a tangible medium when the consumer expressly agrees to immediate delivery and acknowledges the loss of withdrawal rights.

By completing the €7.99 payment and opting to access the application immediately, you expressly consent to immediate delivery and explicitly waive your right of withdrawal. The payment is therefore strictly non-refundable.

5. Account Creation and User Responsibilities

You are solely responsible for maintaining the confidentiality of your login credentials and account data. You must immediately notify us at aloneandalright0@gmail.com of any unauthorized access or security breach. Selling, transferring, or lending your account to any third party is strictly prohibited.

6. Prohibited Conduct

You explicitly agree not to:

  • Attempt to reverse-engineer, bypass, or manipulate the identity verification mechanisms.
  • Deploy automated scripts or scraping tools to harvest data, maps, or user profiles.
  • Post false or manipulated safety reviews with intent to skew algorithmic routing.
  • Harass, dox, intimidate, or threaten other users.
  • Use the platform for any activity unlawful under Dutch law or EU regulations.

7. Content Ownership and License Grant

You retain full ownership of any user-generated content (UGC) — including safety tips, reviews, comments, and images — you submit to the platform.

By posting UGC, you grant Alone&Alright a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, and sublicensable license to use, reproduce, display, adapt, and distribute that content within the application ecosystem and associated promotional materials. This license enables the platform to display your safety tips to the community and integrate data into aggregate safety algorithms.

8. Moderation Rights and DSA Compliance

Alone&Alright reserves the right to review, remove, or suspend any user-generated content that violates these Terms or the Community Guidelines.

In compliance with Article 17 of the Digital Services Act (DSA), any moderation action will be accompanied by a clear "Statement of Reasons" detailing the grounds for the decision, whether automated systems were used, and available appeal options.

9. Limitation of Liability

To the maximum extent permitted by Dutch law, Alone&Alright shall not be liable for any indirect, incidental, consequential, or punitive damages. Total cumulative liability for direct damages is capped at €7.99 (the amount paid by the User).

Mandatory Exceptions (Dutch law, Art. 6:236 & 6:237 BW): This limitation does not exclude liability for death or personal injury caused by a defect in the platform's service, fraud, intentional misconduct (opzet), or gross negligence (bewuste roekeloosheid) by platform management.

10. Governing Law and Dispute Resolution

These Terms are governed exclusively by the laws of the Netherlands.

  • Step 1 — Internal Complaint: Submit a formal complaint to aloneandalright0@gmail.com. We will respond within 30 days.
  • Step 2 — ODR Platform: If unresolved, you may use the European Commission's Online Dispute Resolution platform.
  • Step 3 — Courts: Unresolved disputes are subject to the exclusive jurisdiction of the competent courts in the Netherlands, without prejudice to your right to bring proceedings in your own EU member state.

11. Service Availability and Modifications

Alone&Alright does not guarantee continuous, uninterrupted operation. The platform reserves the right to modify, update, or discontinue certain features to enhance security or comply with EU legislative obligations.

12. Account Suspension and Termination

Alone&Alright may suspend or permanently terminate an account without prior notice for material breaches including: failing identity verification audits, posting hate speech, or systematically manipulating safety scores. Terminated users forfeit lifetime access with no right to a refund.

13. Updates to These Terms

Material changes will be communicated via in-app alert or email no less than 14 days before the effective date. Continued use of the application after that date constitutes acceptance of the updated Terms.
